Elder Law Abuse: New Jersey Legislature Advances Act To Protect Elder Abuse Known As “Granny Snatching”

The New Jersey legislature is advancing a bill, the New jersey Adult Guardianship and Protective Proceedings Jurisdiction Act, which would allow New Jersey to join the national guardianship reciprocity network followed by 30 states.

The issue involves conflicts in guardianship situations, often resulting in family feuds, such as when a guardianship for an incapacitated elderly person has been approved by the New Jersey courts, the elderly person is permitted to visit a relative out of state and the relative refuses to return the person to New Jersey and seeks a new guardianship in  the other state.  Without this legislation, New Jersey does not have the power to bring this person back to the state.
