AseraCare, a national hospice company is being sued for fraud. The allegations are that AserCare would transfer residents to hospice care to collect Medicare payments. Nursing homes can bill Medicare for a very limited amount of days for skilled nursing care. The suit alleges that after Medicare is billed for the skilled nursing care, AseraCare would transfer residents to hospice. Hospice care is supposed to be benefits for the last six months of the resident’s life. Under Medicare rules, a resident is to be discharged from hospice if no longer terminal and expected to die in six months.
Aseracare denies the charges and contends that it is not possible to predict how residents will respond to challenging illnesses.
